Nikon Prostaff 7 2.5-10x50 $350
Leupold VX-2 4-12x40 $350
will be going on a 7mm-08 deer rifle where my shots are from under 10yards out to 300ish
will spend up to $400 max but trying to save some money

Generally, your best bet is Meopta MeoPro 3-9x40. If you look around, you can find it for about what you are willing to spend.
If you are trying to save a little money, I think I like the Diamondback HP from Vortex a bit more than the options you listed above: If you would rather have something without side focus: Lastly, if you are really on a budget, consider Burris Fullfield II 3-9x40. |

10 yards means you need 2.5x or less on the low end. 300 yards can be done with 6x, no problem. Everyone seems to depend on the higher magnification for sighting in or the relatively rare long shot on game, but the majority of your shots will be at lower magnification. You can get by with 3x on the low end, but there's no sense in planning on having to get by.
The VX3 1.75-6x, Weaver Grand Slam 2-8x and Weaver Super Slam 2-10x are a few available in your price range.
